Terms of Service

The agreement between you and us for using Avocando.

These terms are the agreement between you and Mysmartliving Inc., 2222 S Sheridan Way #212, Mississauga, Ontario L5J 2M4, Canada ("we", "us", "Avocando"). They cover your use of the Avocando app. By using it you accept them. If you don't, please don't use the app.

How we handle your data is set out in the Privacy Policy, which is part of these terms.

1. What Avocando is

Avocando is a personal money tracker. You photograph a receipt, an AI model reads it, and the app records a transaction. You can also add entries by hand, set budgets, record recurring bills, see monthly insights, and keep a shared ledger with your household.

It's a record-keeping tool. It isn't a bank, a payment service, accounting software or a tax product. It never connects to your bank and never moves money.

2. Who can use it

You must be at least 13. In Quebec you must be at least 14, or have a parent's or guardian's consent. You must not be barred from using the app by the laws that apply to you.

3. Your account

You can use Avocando as a guest, or sign in with your email, Apple or Google.

A guest account can't be recovered. It lives only on the phone that created it. If you delete the app, lose the phone or reset it, the data is gone, and neither you nor we can bring it back, because nothing ties the account to you. You can add a sign-in method at any time and keep everything you've recorded. Do it before something happens to the phone.

You're responsible for what happens under your account and for keeping your email, Apple ID or Google account secure. If you think someone else has got into it, write to avocando@workshown.com.

4. Scans can be wrong

Receipts are read by an AI model. Thermal print fades, paper creases, photos blur, and models misread. A wrong digit becomes a wrong total, and every figure built on it is wrong too. So:

  • Check a scan before you save it. That's what the review screen is for.
  • Every figure in the app is your own record of what you spent. We don't verify it, and it isn't a receipt, an invoice, a bank statement or a tax record.
  • Don't rely on Avocando for tax, accounting, audits, reimbursements or any legal or financial obligation without checking the original receipts yourself.
  • Budgets, insights, category totals and currency conversions are for information. Exchange rates are the European Central Bank's published daily rates, and won't match exactly what your card or a currency exchange charged.

5. Fair use

Each account can scan a limited number of receipts a day, because every scan costs us money. The limit is well above normal use. When you reach it, the app tells you, and you can scan again the next day.

You agree not to:

  • upload documents you have no right to upload, such as someone else's receipts or identity documents;
  • upload things that aren't receipts or invoices to use the AI model for something else;
  • get around the scan limit or any other restriction, including by creating extra accounts;
  • try to access another person's data, or probe or test our systems without written permission;
  • reverse engineer the app, except where the law allows it despite this clause;
  • use Avocando to break the law, or in a way that harms the service or other people.

If you do, we may limit or close your account. Where it's reasonable, we'll tell you why first.

6. Your content

Your receipts and entries are yours. We don't claim ownership of them.

You give us only the permission we need to run the app for you: to store, transmit, process and display your content, and to send receipt images to our AI provider to be read. That permission ends when you delete the content or your account.

We don't use your content to train AI models, and neither does our AI provider. See section 4.3 of the Privacy Policy. You confirm you have the right to upload what you upload.

7. Households

If you create or join a household:

  • entries you share are visible to every member, with your display name;
  • entries you keep private are yours alone, and no other member can read, edit or delete them;
  • a household uses one currency, and every member has to be using it already;
  • leaving doesn't remove what you already shared. Those entries stay in the household's ledger with your name on them. To remove them, delete them before you leave, or delete your account.

An invite code lets someone see your shared spending. Only give it to people you want to see it.

8. Changes and price

We may change, pause or stop any part of Avocando, and we may change these terms.

  • If we change these terms in a way that matters, we'll tell you in the app before the change takes effect. If you keep using Avocando after that, you accept the new terms. If you don't accept them, stop using the app and delete your account.
  • If we shut Avocando down, we'll give you reasonable notice and time to export your data.
  • Avocando is a paid app. Before you pay, the app shows the price, what it includes and how long any free trial lasts. You pay through Apple, and Apple handles billing, renewals, cancellations and refunds under its own terms.

9. Ending it

You can stop at any time. To delete your account, go to Settings, Delete data, Delete my account. That removes your data and the account straight away. It can stay in our server backups for a short time until they're replaced, as the Privacy Policy explains.

We may suspend or close your account if you seriously break these terms, if the law requires it, or if we shut Avocando down. Unless that's impossible or unlawful, we'll tell you first and give you a chance to export your data.

Sections 4, 6, 10, 11, 12 and 14 continue after this agreement ends.

10. Warranties

As far as the law allows, Avocando is provided "as is" and "as available", and we exclude all implied warranties and conditions, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the app will always be available or free of errors, that scans will be accurate, or that any figure it shows is correct.

Rights the law gives you

Nothing in these terms takes away a right or remedy that consumer protection law gives you and doesn't allow a business to exclude. That includes Ontario's Consumer Protection Act, 2002, the equivalent law in your province or territory, the Australian Consumer Law, New Zealand's Consumer Guarantees Act 1993, and the consumer laws of wherever else you live.

  • Quebec. The Consumer Protection Act and the Civil Code of Québec limit how far a business can exclude or limit its liability to a consumer. We don't exclude liability for bodily or moral injury, or for intentional or gross fault. Where anything in sections 10 or 11 conflicts with those rules, those rules apply instead.
  • Australia. Our services come with guarantees that can't be excluded under the Australian Consumer Law. Where the law lets us limit our liability for failing to meet one of them, our liability is limited to supplying the service again or paying the cost of having it supplied again.

11. Liability

Subject to section 10:

  • We aren't liable for indirect, incidental, special, consequential or punitive loss, or for lost profits, revenue, data or opportunity, however caused.
  • We aren't liable for decisions you make based on figures in the app, including a misread total, a wrong category, a wrong conversion or an entry a scan missed.
  • Our total liability for all claims about Avocando is limited to what you paid for Avocando in the 12 months before the claim. If you haven't paid anything, for example during a free trial, we have no liability to pay you anything.

Some places, Quebec among them, don't allow these limits. Where that's the case, they apply only as far as the law permits.

12. Indemnity

You agree to cover our claims, losses and reasonable legal costs that result from your breaking these terms, misusing the app, or uploading content you had no right to upload. This doesn't apply to the extent a claim comes from our own breach or negligence, and it doesn't apply at all where the law where you live doesn't allow it.

13. The App Store

Avocando is distributed through Apple's App Store. Apple requires these terms:

  1. This agreement is between you and Mysmartliving Inc. only, not Apple. Apple isn't responsible for Avocando or its content.
  2. We, not Apple, are solely responsible for Avocando and for its maintenance and support. Apple has no obligation to provide any maintenance or support for it.
  3. If Avocando fails to meet an applicable warranty, you can tell Apple, and Apple will refund the purchase price, if any. As far as the law allows, Apple has no other warranty obligation for Avocando.
  4. We, not Apple, are responsible for any claim by you or anyone else about Avocando, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection or similar laws.
  5. We, not Apple, are responsible for investigating, defending, settling and discharging any claim that Avocando infringes someone's intellectual property.
  6. You confirm that you aren't in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you aren't on any U.S. Government list of prohibited or restricted parties.
  7. You must follow any third-party terms that apply when you use Avocando.
  8. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you.

14. General

  • Governing law. These terms are governed by the laws of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have non-exclusive jurisdiction.
  • If you're a consumer, that doesn't take away the protection of the mandatory laws where you live, or your right to bring a claim there. A consumer living in Quebec can always bring a claim before the courts of Quebec.
  • Whole agreement. These terms and the Privacy Policy are the whole agreement between us about Avocando.
  • Severability. If part of these terms can't be enforced, the rest still applies.
  • No waiver. If we don't enforce something straight away, we can still enforce it later.
  • Transfer. You can't transfer this agreement. We can transfer it, with notice to you, to whoever takes over our business.
